En "Legal Reasons, Sources and Gaps", Raz señala que las lagunas jurídicas existen sólo cuando el derecho habla con voz incierta o cuando habla con muchas voces, pero que no hay lagunas cuando el derecho guarda silencio. En este último caso habría reglas de clausura, analíticamente verdaderas, que impiden la ocurrencia de esas lagunas. Según Raz, si hay una laguna en un sistema jurídico, entonces no es verdadero ni falso que exista una razón concluyente para ejecutar cierta acción. Así, una (...) de las contribuciones más importantes de Raz a la solución del problema de las lagunas jurídicas es subrayar que el discurso jurídico no está completamente controlado por la bivalencia. Sin embargo, a menudo se sostiene que el rechazo de la bivalencia conduce a contradicciones. Si esta afirmación fuese verdadera, entonces la solución de Raz al problema de las lagunas jurídicas se vería seriamente amenazada. En este artículo mostramos, con ayuda de una herramienta analítica sofisticada, i.e., la lógica de la verdad de G.H. von Wright, que el rechazo de la bivalencia sólo nos compromete a aceptar la conclusión trivial de que puede haber proposiciones que no son verdaderas ni falsas. Por esta razón, el trabajo de Raz todavía puede ser considerado un buen punto de partida para analizar las relaciones entre normas, razonamiento práctico y lagunas jurídicas. Sin embargo, también mostramos que para admitir proposiciones que no son verdaderas ni falsas, las tesis de Raz deben ser reformuladas. De otra manera, la tesis de que no existen lagunas cuando el derecho guarda silencio no sería compatible con el rechazo de la bivalencia. /// In his paper "Legal Reasons, Sources and Gaps", Raz says that legal gaps only exist when law speaks with uncertain voice or when it speaks with many voices, but there are no gaps when law is silent. In this later case, rules of closure, which are analytically true, prevent from the occurrence of gaps. According to Raz, if there is a gap in a legal system, then both the claim that there is a conclusive legal reason to perform a certain action, and its negation are neither true nor false. Therefore, one of the Raz's most important contributions to the solution of the problem of legal gaps is to remark that legal discourse is not altogether governed by the principie of bivalence. However, philosophers often claim that the denial of bivalence leads to a logical inconsistency. If this claim were true, then Raz's solution to the problem of gaps would be seriously threatened. In this paper we show--with the aid of a sophisticated analytical tool, i.e., von Wright's truth-logic--that the rejection of bivalence only commits us to accept the trivial conclusion that propositions can lack truth-values. For this reason, Raz's paper can still be regarded as a good starting-point for analyzing the relationships between norms, practical reasoning and legal gaps. However, we also show that in order to admit propositions which are neither true nor false, Raz's theses must be reformulated. Otherwise, the claim that there is no gap when law is silent would not be compatible with the rejection of bivalence. (shrink)

Finkelstein propone en La expresión y lo interno un análisis expresivista del autoconocimiento. Podría parecer cuando menos sorprendente y aún más admirable que con tan sólo dos capítulos (“Detectivismo y constitutivismo” y (...) “Expresión”) y un Epílogo (“Deliberación y transparencia”), Finkelstein haya conseguido presentar en esta obra un planteamiento calificado por muchos como una auténtica renovación de la discusión analítica en torno al tema del autoconocimiento, o sea, acerca del problema de qué clase de autoridad quepa atribuir a las expresiones sobre nuestros propios estados de ánimo y/o nuestros estados mentales sin más. The objective of this paper is to discuss the relationship between the functional properties and information-processing modes of the human brain and the evolution of scientific thought. Science has emerged as a tool to carry out predictive operations that exceed the accuracy, temporal scale, and intrinsic operational limitations of the human brain. Yet the scientific method unavoidably reflects some fundamental characteristics of the information-acquisition and -analysis modes of the brain, which impose a priori boundary conditions upon how science can develop (...) and how the physical universe can be “understood.” A brief description of physical and biological interactions is given, with emphasis on the defining role played by the concept of information. Current views on the information-processing and information-generating mechanisms of the human brain are briefly reviewed. It is shown how some particular features of superstition, natural philosophy, physical thought, and intuition can be linked to certain characteristic information-processing modes of the brain. A discussion is given of how greatly expanded knowledge of brain functions might affect the future of science and technology. (shrink)

We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law. The aim of this study was to identify key aspects in the exchange of information and to determine how nurses communicate news to hospitalised children. For this study, we applied the critical incident technique with 30 children aged between 8 and 14 years. Data were collected in paediatric units in a hospital in Alicante (Spain) using participant observation and semi-structured interviews. The analysis yielded three main categories: the children’s reaction to the information, nursing staff behaviour as a key aspect in (...) the exchange of information and communication of news as well as children’s experience. This article emphasises the need to promote children’s consent and participation in nursing interventions. An analysis of these aspects will verify whether children’s rights are being respected and taken into account in order to promote children’s well-being and adaptation to hospitalisation. (shrink)

Para las tradiciones escolásticas budistas, el universo es inseparable de la vida mental de los seres que lo habitan, siendo las acciones de los seres, con sus estados mentales asociados, las que trazan el mapa y calendario cósmico. Algunos investigadores han visto en estas asociaciones entre mente y universo la «contraparte imaginativa, mítica y poética de los estados meditativos». Este artículo intenta mostrar cómo la propia escolástica mantiene cierta ambigüedad sobre si el cosmos debe entenderse como una metáfora de la (...) mente o debe identificarse literalmente con ella. Algunos pasajes establecen una complementariedad que parece afirmar la existencia independiente de ambos. Sea como fuere, contrastar las descripciones de estados mentales con relatos cosmogónicos nos permitirá comprender mejor la idea del cosmos en el budismo antiguo. (shrink)

Intentamos dilucidar el sentido que pueda encerrar el título de nuestro ensayo, respecto al espacio de la «metafísica» y no tanto al que se refiere a «El conflicto de las Facultades». Pues, sabido es, menciona el texto kantiano que trata del conflicto que surge, en el espacio público, entre distintos saberes, en el que están en juego en última instancia, la verdad, el bien, la justicia y la libertad. Lo que puede significar eso de «el espacio mundano» de la metafísica (...) dependerá, claro, de qué se entienda más ajustadamente por «metafísica» y sobre todo por «mundano». Pero antes aún de todo ello no puede esperar más la pregunta de qué, si algo, tiene que ver esto último con el asunto considerado en «el conflicto de las facultades». (shrink)

After arguing that Hume’s judgment on metaphysics is more nuanced than it is usually believed, the relationship between the theory of meaning and the concept, or rather the problem, of “human nature” is analysed in order to underline the relevance of human nature to the explanation of the genesis of meaning and to the extent of the principle of copy, so as to finally examine the relation between meaning and theological discourse.

El objetivo principal de este estudio es el de presentar y evaluar una experiencia didáctica realizada en 1.º de Bachillerato sobre el tema de La Retirada, el exilio español en 1939 tras la Guerra Civil. Para ello, se presenta el diseño de esta experiencia en el contexto de un instituto valenciano de secundaria, llevada a cabo en los cursos escolares de 2022-2023 y 2023-2024, así como los resultados de una encuesta realizada al alumnado participante de esta salida de campo. En (...) esta encuesta se confirma la idoneidad de la actividad desde el punto de vista metodológico (movilidad Erasmus e itinerario didáctico), así como por el aprendizaje suscitado en torno al exilio y la memoria democrática. Dynamic Assessment (DA) has been shown to have more predictive value than conventional tests for academic performance. However, in relation to reading difficulties, further research is needed to determine the predictive validity of DA for specific aspects of the different processes involved in reading and the differential validity of DA for different subgroups of students with an academic disadvantage. This paper analyzes the implementation of a DA device that evaluates processes involved in reading (EDPL) among 60 students with reading comprehension (...) difficulties between 9 and 16 years of age, of whom 20 have intellectual disabilities, 24 have reading-related learning disabilities, and 16 have socio-cultural disadvantages. We specifically analyze the predictive validity of the EDPL device over attitude towards reading, and the use of dialogue/participation strategies in reading activities in the classroom during the implementation stage. We also analyze if the EDPL device provides additional information to that obtained with a conventionally applied personal-social adjustment scale (APSL). Results showed that dynamic scores, obtained from the implementation of the EDPL device, significantly predict the studied variables. Moreover, dynamic scores showed a significant incremental validity in relation to predictions based on an APSL scale. In relation to differential validity, the results indicated the superior predictive validity for DA for students with intellectual disabilities and reading disabilities than for students with socio-cultural disadvantages. Furthermore, the role of metacognition and its relation to the processes of personal-social adjustment in explaining the results is discussed. (shrink)

Esta fue una de las últimas jugadas maestras de estrategia política de la fulgurante carrera ciertamente no académica de la canciller alemana Angela Merkel, quien anunció que Alemania aportará una financiación anual de treinta millones de euros.

Der Kodex, mit dem sich die Produzenten des universellen Wissens in der Gelehrtenrepublik identifizierten, befindet sich während des 18. Jahrhunderts im Wandel. Dies entnehmen wir einer bekannten Studie von Goldgar (1995), die unter anderem von der Ausbreitung der Zeitungspresse handelt. Zum Teil war dieser Umstand durch die Erfordernisse zeitgenössischer Höflichkeits- und Zivilitätskonzepte bedingt, aber auch den ökonomischen Aspekten eines stoßkräftigen Verlagsmarktes geschuldet, der sich aus dem damaligen Aufstieg der sogenannten Papierzeitungen ergab.

Understanding Information and Communication Technologies through the networks in which people get con¬nected, communicate and co-operate has been a constant feature in the work of researchers who have not dissociated their view of the meaning of technologies from new social movements. This paper maintains that Information and Communication Technologies are not only networks that people join individually, but they also act as social technologies. Their improvement depends both on the diversity of their functions (social, political, cognitive, etc.) and the flexibility (...) with which they adapt to functional diversity (for example, to life cycles, changing and fluctuating mobility or audiovisual perception thresholds). This idea is supported by the new technological challenge represented by portable devices, such as, personal area networks, high-use user interfaces, and systems designed for home care. These important changes will be explored in this paper in connection with their value for education. (shrink)

Lorenzo Peña y Gonzalo has developed a logic, a legal philosophy and a political thought of a deeply neo-Leibnizian nature. The neo-Leibnizian mark characterizes both his philosophical thesis and the terms has coined in his contributions to the theory of knowledge, theodicy, ontology, political philosophy, etc. Above all, this mark is present in his conception of Law and of the logic of legal situations. Este artículo propone un análisis de la estética del paisaje en la obra del escritor Gabriel Miró. Para ello se investiga el significado y valor atribuido al paisaje en la trilogía novelesca de Sigüenza, héroe modernista de su paisaje literario, así como en el ensayo Sigüenza y el mirador azul. La visión del paisaje en Miró se reconstruye a través del diálogo con diferentes fuentes culturales y filosóficas. El paisaje mironiano muestra así la evolución desde una inicial actitud panteísta hacia (...) una posterior mirada fenomenológica y hermenéutica. (shrink)

I attempt to clarify the specificity of Spinoza’s hermeneutic proposal of the Scripture in the Political-Theological Treatise. In this regard, I assume two levels of analysis in Spinoza interpretation: the historic-critical and the philosophical one. My aim is to find out the relationships between these two levels, and also the differences of Spinoza’s interpretation with others, in particular, that one developed by Lodewijk Meyer in his Philosophia S. Scripturae Interpres.

Le but de cet article est d’étudier l’enseignement des mathématiques au Collège d’Artillerie espagnol de 1764 à 1842, et de repérer les influences étrangères sur elle. Après quelques hésitations, un programme standard est adopté commençant par l’arithmétique et finissant par le calcul différentiel et intégral et la mécanique. L’unique changement important fut en 1819 quand la mécanique devint une matière indépendante. Pendant les premières décennies, avec Giannini comme premier professeur, l’emprise italienne était importante, néanmoins il existait une influence française et (...) anglaise. Avec le temps l’inspiration française augmenta. Les manuels employés pendant la plupart du temps étaient ceux de Giannini ou Odriozola, professeurs du Collège; mais ils ont utilisé aussi des livres de mathématiciens français comme Lacroix, Legendre ou Monge. The present article studies the impact of foreign influence on mathematics education at the Spanish Royal College of Artillery from 1764 to 1842. After some vacillation, the academy’s standard teaching program included from arithmetic to calculus and mechanics. The most noteworthy change occurred in 1819 when mechanics would be considered as an independent subject. During the first decades during which time Giannini was first professor, the academy’s approach to teaching mathematics was mostly influenced by methods being used in Italy and, to a certain degree, in England and France. French influence increased considerably with time. While most of the textbooks used at the academy were authored by two of its professors, Giannini and Odriozola, the curriculum would be expanded to include works by French mathematicians such as Lacroix, Monge and Legendre. After arguing that Hume’s judgment on metaphysics is more nuanced than it is usually believed, the relationship between the theory of meaning and the concept, or rather the problem, of “human nature” is analysed in order to underline the relevance of human nature to the explanation of the genesis of meaning and to the extent of the principle of copy, so as to finally examine the relation between meaning and theological discourse.

In the last forty years the number of specialized publications on deliberative democracy has increased steadily. Yet, today, one of the greatest challenges we still face today is to deepen into the knowledge of our actual and singular deliberative cultures. In order to achieve this, it is necessary that we use theoretical and methodological approaches that enable us to capture the inherent complexity to the specific forms of deliberation that are present in as different areas as that of politics, economics, (...) law, science, urbanism or the Net.
